In a US District Court, Melinda Haag, the U.S. attorney for Northern California, can’t provide a compelling state interest to show the federal marijuana laws are reasonable and necessary to shut down any operation that distributes marijuana for any reason. Under the Constitution, Congress doesn’t have the authority to criminalize marijuana. There is no victim of a crime. Criminal law is defined as “A body of rules and statutes that defines conduct prohibited by the government because it threatens and harms public safety .”http://legal-dictionary.thefreedictionary.com/Criminal+Law Criminalizing marijuana is arbitrary, unreasonable and unnecessary regulation of our fundamental rights to property, to liberty, and to privacy and contravenes the Fourth, Fifth, and the Commerce Clause of the Constitution of the United States. Being arrested is deprivation of liberty. Seizing marijuana is deprivation of property. A search warrant is an invasion of privacy. Due process of law requires the deprivation of fundamental rights be justified by a compelling state interest to protect public safety. The private sale and use of marijuana does no threaten the rights of others. There is no victim of a crime. www.ursm.us Since Ravin v Alaska (1975) no lawyer from any organization has defended fundamental rights to liberty, to property and to privacy from unreasonable and unnecessary government intrusion a law court. It is about time the ACLU defend our civil liberties.
