Todd Willingham case in recess until Oct. 14
camerontoddwillingham.com A hearing began Wednesday in Austin to determine if a Texas man was wrongfully sentenced to the death penalty. The case was postponed until Oct. 14 after a motion was filed for the recusal of Travis County District Judge Charlie Baird. Cameron Todd Willingham was executed in 2004 for starting a fire that killed his three daughters. The motion was filed by Navarro County District Attorney R. Lowell Thompson. In the motion, Thompson cites Judge Baird's service on the Texas Court of Criminal Appeals and his vote in 1995 to uphold Willingham's conviction and death sentence. The motion also cites a document Baird previously wrote that upheld Willingham's guilt. The motion states Baird's previous involvement in the case creates a conflict of interest. Cameron Todd Willingham Baird postponed the hearing to review the motion, and will give both sides a chance to present their opinions when court resumes next Thursday. If Baird excuses himself from the hearing, an administrative judge will take over the case.
